9. General Representation and Warranty

You represent and warrant that (i) your use of our Services will comply strictly with the Book Writing Space Privacy Policy and this Agreement, and all applicable laws and regulations (including, without limitation, any local laws or regulations in your country, state, city, or other governmental area, concerning online conduct and acceptable content, as well as all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside); and (ii) your use of our Services will not infringe or misappropriate the intellectual property rights of any third party.

10. Book Writing Space and U.S. Economic Sanctions

By using our Book Writing Space and associated services and products, you explicitly confirm and assure that your usage complies with all relevant U.S. Sanctions. Any usage that violates these sanctions is strictly prohibited. Book Writing Space reserves the right to terminate accounts or access of users found in breach of this condition.

11. Indemnification

You agree to indemnify and hold harmless Book Writing Space, its contractors, licensors, as well as their respective directors, officers, employees, and agents, from any and all claims and expenses, including attorney's fees, arising from your utilization of our Book Writing Space services, including but not limited to any violation of this agreement.

12. Translation

These Terms of Service were originally drafted in English (US). We may translate these terms into other languages. If there is any conflict between the translated version of these Terms of Service and the English version, the English version will take precedence.

13. Miscellaneous

This Agreement constitutes the entire understanding between Book Writing Space and you regarding its subject matter, and it can only be modified through a written amendment signed by an authorized executive of Book Writing Space, or by the posting of a revised version by Book Writing Space. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys' fees. If any part of this Agreement is deemed invalid or unenforceable, that part will be interpreted to reflect the parties' original intent, and the remaining portions will remain fully effective. Waiver by either party of any term or condition of this Agreement, or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Book Writing Space may assign its rights under this Agreement without any conditions. This Agreement will be binding upon and will benefit the parties, their successors, and permitted assigns.
